For more than a year, Clark Perdue has been investigating and pursuing claims for women who have suffered injury as a result of the Paragard® IUD.  This is a brief update on the status of these case.

In December 2020, the the United States Judicial Panel on Multidistrict Litigation (JPML) transferred ParaGard® federal cases to the Northern District of Georgia.

There are hundreds of cases filed in this consolidated litigation.  The parties continue to engage in discovery—a formal process during which each side gathers evidence to support the allegations and defenses—in preparation for trial.  As discovery progresses, both sides will try to identify “bellwether” cases—cases where the facts and legal issues are representative of the many other cases consolidated before the court.  Generally, the bellwether cases are the first to be tried to a jury.  It is anticipated that bellwether trials may begin in 2023.
