August 8, 2011 -- 2011 Trial Advocacy Institute Finalized

We have finalized the 2011 Trial Advocacy Institute to be held at the Crowne Plaza on September 16, 2011 in downtown Columbus. The Ohio Supreme Court has approved the program for 6.0 hours of CLE credits. Take a look at the final agenda, with links to each speaker's biography, and the registration brochure.

June 14, 2011 -- 2011 Trial Advocacy Institute to be Held September 16, 2011

We are pleased to announce our 2011 Trial Advocacy Institute. This seminar-presented with our colleagues at Anapol, Schwartz, Weiss, Cohan, Feldman & Smalley, P.C.-will feature trial strategies and innovative techniques for cutting edge litigation.

We will review recent changes in the law and address the greatest challenges faced by trial lawyers today. This year, our faculty includes elite, national practitioners who are leaders in the areas of pharmaceutical, medical device, mass tort and class action litigation.

Here is a preview of the agenda. Approval is being sought with the Ohio Supreme Court Commission on Continuing Legal Education for 6.0 CLE credit hours.

Details will follow later this Summer. We hope that our Colleagues will join us on September 16, so that we can all work together to provide the highest level of legal representation to seriously injured consumers and their families.

September 3, 2009 -- The Minnesota Supreme Court decides Fleeger v. Wyeth.

In Fleeger, the Court was asked to consider a question certified from the U.S. District Court for the Western District of Arkansas (the multi-district court for the consolidated Prempro pharmaceutical litigation):

"In a case commenced in Minnesota, does the Minnesota statute of limitations apply to the personal injury claims of a non-Minnesota resident against a defendant not a resident of Minnesota, where the events giving rise to the claims did not occur in Minnesota before and took place before August 1, 2004?"

The Court answered the question in the affirmative.
This is an important decision for injured consumers inasmuch as Minnesota has a six-year statute of limitations for most negligence-based claims, including failure to warn claims involving pharmaceuticals. The decision confirms the viability of many existing claims that had been previously filed in Minnesota. Moreover, it provides a small window of time for consumers to file claims that arose in late 2003 or early 2004, before the expiration of the six-year time limit on August 1, 2010.
